1. Agreement to Terms
These Terms & Conditions ("Terms") govern your use of the DINEIN Malta mobile application and website (the "Service"), operated by DINEIN Malta ("we", "our", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Description of Service
DINEIN Malta is a dine-in ordering platform that allows customers to:
- Scan a QR code at a partner restaurant to access the venue's menu.
- Browse menu items and place dine-in orders from their table.
- Track order status in real time (Placed → Received → Served).
DINEIN is a dine-in only service. We do not offer delivery, takeaway, or any logistics services.
3. User Accounts
You may use certain features of DINEIN without creating an account. If you create an account, you are responsible for:
- Providing accurate and up-to-date information.
- Maintaining the confidentiality of your login credentials.
- All activities that occur under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Ordering & Payments
4.1 Placing Orders
When you place an order through DINEIN, you are placing an order directly with the restaurant venue. DINEIN acts as a technology intermediary and is not a party to the transaction between you and the venue.
4.2 Pricing
Menu prices are set by each venue and may change at any time. DINEIN does not control pricing and is not responsible for pricing errors on behalf of venues.
4.3 Payment
DINEIN does not process payments within the app. Payment is handled directly between you and the venue through:
- Cash — paid directly at the venue.
- Revolut — via an external link that opens outside the app.
DINEIN charges no service fees to customers for using the platform.
4.4 Order Cancellations
Orders may be cancelled if the venue has not yet begun preparing your food. Once an order status changes to "Received", cancellation is at the venue's discretion. Refund disputes must be resolved directly with the venue.
5. Venue Owners
5.1 Registration
Venue owners may register their establishment on DINEIN through the venue claim process. Registration is subject to verification and approval by DINEIN.
5.2 Menu Management
Venue owners are solely responsible for the accuracy of their menu information, including item names, descriptions, prices, and availability.
5.3 Order Fulfilment
Venue owners are responsible for fulfilling orders placed through DINEIN in a timely and professional manner. Failure to do so may result in removal from the platform.
6. Prohibited Conduct
You agree not to:
- Use the Service for any illegal or unauthorised purpose.
- Interfere with or disrupt the Service or its infrastructure.
- Attempt to gain unauthorised access to any part of the Service.
- Scrape, crawl, or use automated means to extract data from the Service.
- Impersonate another person or entity.
- Submit false or misleading information.
7. Intellectual Property
All content, design, code, graphics, and branding associated with DINEIN (including the "DINEIN" name, logo, and visual design) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
8. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to:
- The Service will be uninterrupted, secure, or error-free.
- The accuracy, reliability, or completeness of any content (including venue menus).
- The quality of food or service provided by partner venues.
9. Limitation of Liability
To the maximum extent permitted by Maltese and EU law, DINEIN Malta shall not be liable for:
- Any indirect, incidental, special, or consequential damages.
- Loss of profits, data, or business opportunities.
- Any harm arising from the food, service, or conduct of partner venues.
- Any issues arising from third-party payment processing (Revolut, cash).
Our total liability for any claim related to the Service shall not exceed €100.
10. Indemnification
You agree to indemnify and hold harmless DINEIN Malta, its directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of Malta. Any disputes shall be subject to the exclusive jurisdiction of the Maltese courts, without prejudice to your rights under EU consumer protection regulations.
12. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated through the app or website. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
